The Haryana Real Estate Regulatory Authority (HRERA) has directed Godrej Highview to hand over delayed apartments in its Godrej Nature Plus project in Sector 33, Sohna, while also compensating homebuyers through statutory delay interest until possession is delivered.
The case was filed by three homebuyers who booked an apartment in 2018. As per the buyer agreement, possession was due by 30 June 2023. After the COVID-related six-month extension granted by HRERA, the revised possession deadline became 30 December 2023. However, the project had still not received its Occupation Certificate (OC), prompting the buyers to approach the regulator.
During the proceedings, the developer attributed the delay to force majeure events, including the pandemic, labour shortages, supply-chain disruptions, and construction restrictions caused by pollution-control measures. HRERA observed that the COVID extension had already accounted for these circumstances and ruled that additional extensions could not be granted on the same grounds.
What HRERA ordered
In its final order, HRERA instructed the developer to:
- Deliver the apartments after obtaining the Occupation Certificate.
- Ensure the units are handed over in a habitable condition.
- Pay statutory delay-possession interest to the affected buyers until the actual handover.
- Refrain from imposing charges that are not part of the buyer agreement.
The authority also clarified that contractual responsibility for project delivery rests solely with the developer, dismissing claims against landowners and other associated entities that were not signatories to the buyer agreement.
